Agreement to Terms
By engaging Test Australia Pty Ltd (ABN 33 613 942 297) ("Test Australia", "we", "us") for contamination testing services, purchasing products from our website, or using our website, you agree to be bound by these Terms of Service.
Services
Contamination Testing Services
Test Australia provides property contamination assessment services including methamphetamine testing, mould inspection, bacteria testing, fire damage assessment, and related testing services. Our services include:
- On-site property inspection and sample collection
- Laboratory analysis through NATA-accredited partners
- Professional assessment reports with findings and recommendations
- Expert interpretation of results
DIY Test Kits
We also sell DIY test kits for preliminary screening purposes. These kits are intended for screening only and do not replace professional assessment. Positive screening results should be confirmed through professional testing.
Booking and Payment
Service bookings are confirmed upon receipt of deposit or full payment as specified in the quote. Prices quoted are valid for 30 days unless otherwise stated. Payment terms are:
- Professional services: 50% deposit to confirm booking, balance due upon report delivery
- DIY test kits: Full payment at time of purchase
- Express services: Full payment in advance
Cancellation Policy
Cancellations must be made at least 48 hours before the scheduled assessment. Cancellations with less than 48 hours notice may incur a cancellation fee of up to 50% of the quoted price. We reserve the right to reschedule assessments due to weather or other circumstances beyond our control.
Report Delivery
Assessment reports are typically delivered within 3-5 business days of sample collection, subject to laboratory turnaround times. Express services are available for additional fees. Reports are delivered electronically unless hardcopy is specifically requested.
Limitations of Service
Our assessments and reports are based on:
- Conditions observed at the time of inspection
- Samples collected from accessible areas
- Information provided by the client
- Laboratory analysis of collected samples
We do not guarantee that contamination is not present in areas not sampled. Hidden contamination, contamination occurring after assessment, or contamination in inaccessible areas may not be detected.
Professional Independence
Test Australia maintains complete independence from remediation contractors. We do not perform remediation services and have no financial interest in remediation outcomes. Our assessments provide independent, unbiased findings.
Liability
Our liability is limited to the fees paid for the specific service in question. We are not liable for:
- Decisions made based on our reports
- Consequential, indirect, or special damages
- Third-party claims
- Loss of property value or transaction failure
- Results from DIY test kit misuse
Intellectual Property
Assessment reports are provided for the exclusive use of the commissioning client. Reports may not be reproduced, distributed, or used by third parties without our written consent. The report and its methodology remain our intellectual property.
Confidentiality
We treat all client information and assessment results as confidential. We will not disclose results to third parties without your consent, except where required by law.
Website Use
When using our website, you agree not to:
- Use the website for unlawful purposes
- Attempt to gain unauthorised access to our systems
- Copy or reproduce website content without permission
- Submit false or misleading information
Governing Law
These Terms are governed by the laws of Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of Australia.
Changes to Terms
We may update these Terms from time to time. Continued use of our services or website after changes constitutes acceptance of the updated Terms.
